08/10 / 2020.- The Spanish Lawyers and the multinational company Experian have presented this morning a collaboration agreement to help reduce delinquencies between freelancers and individuals. As a result of the agreement, Experian, the largest leading technology company in information and analysis on solvency of natural and legal persons in Spain, will manage the data on defaults of natural and self-employed persons, included in the Registry of Judicial Debtors (RIJ), the first and the only file in Spain based on final court decisions.
The agreement was presented today by the president of the General Council of Spanish Lawyers (CGAE), Victoria Ortega, the CEO and president of Experian for Spain and Portugal, Rita Estévez, the CEO of Informa D&B, Juan Mª Sainz, and the partner founder and CEO of the RIJ platform, José Enrique Rodríguez Zarza.
This agreement represents a great advance in Spain to provide the financial system and other economic operators with greater transparency regarding the information on delinquency between individuals and the self-employed, which will allow credit and contractual decisions to be made in a more robust and secure way with the guarantee provided by the support of the judicial decisions.
The data in the market showed that before the pandemic 1 in 3 self-employed suffered defaults. Covid-19 has only made the situation tougher.
This agreement will also allow a more effective claim for enforceable debts through a firm judicial resolution, provided by lawyers and with the prior authorization of their clients, in defense of their collection rights, improving compliance with sentences and protected by the right to effective judicial protection.
All of this in compliance with the General Data Protection Law, the Law for the Protection of the Right to Honor and the Code of Ethics for the Legal Profession, guaranteeing legal security.
The agreement between the General Council of Spanish Lawyers and Experian represents an innovation in the fight against delinquencies and information management in Spain.
For its part, Experian, reinforces its leadership position in terms of data and advanced analytics, working hand in hand with the Spanish Lawyers to place Spain at the forefront of digitalization in the fight against non-compliance with judicial defaults .

The president of the Spanish Lawyers, Victoria Ortega, explained that the involvement of the Lawyers in the fight against defaults represents a double guarantee for society: on the one hand, because it will serve to force the payment of debts among bad faith defaulters , and on the other hand, because the intervention of lawyers guarantees transparency and legal security in the process of judicial recognition of the debt.
For her part, the CEO and president of Experian for Spain and Portugal, Rita Estévez, highlighted the importance of this agreement, «which will have a positive impact on society by promoting a mechanism to enrich information on delinquency between individuals, self-employed and other agents, which currently exist in the economic and financial system. It also allows providing greater security around the fulfillment of payment obligations related to these groups. «
Estévez added that “this collaboration with ICIRED and with the General Council of Spanish Lawyers is an opportunity to continue advancing in providing innovative solutions that facilitate safe decision-making for the financial sector, companies in other sectors and individuals. It will allow us to complement the existing information on payment defaults in Spain and defend the right to collection when there is a certain, past due and enforceable debt.
Next, Juan Mª Sainz Muñoz, CEO of Informa D&B, a Cesce subsidiary company, indicated that: “Informa entered the capital of Icired more than a year ago as well as in the DAJ company with the General Council of the Lawyers and sells the company data from both files. The agreement with Experian closes the circle by distributing the data on natural persons ”.
Finally, the founding partner and CEO of the RIJ platform, José Enrique Rodríguez Zarza, has emphasized the importance of the agreement reached that will allow the financial system to access information on judicial defaults and that will place our country as one of the more innovative and guarantors in the fight against bad debts.
