14 December 2020.– The publication in the Registry of Judicial Debtors (RIJ) of a non-payment of a maintenance allowance, a rental or sale contract or the breach by a public Administration of a payment obligation, recognized in a Firm judicial resolution, has changed the rules of the game in the Digital Age in the battle against judicial arrears.
The first and only online file of judicial delinquency in the world, created by the Spanish Lawyers, in collaboration with the state company INFORMA (subsidiary of the CESCE group), and the Japanese multinational Everis (subsidiary of NTT DATA telephone company in Japan), was has become, in just one year, an essential and necessary tool to enforce part of the more than 2.3 million sentences that annually enter pending execution in Spanish courts and tribunals.
This technological solution to solve the payment problems of clients and lawyers themselves, has raised, in his young age, more than 30 million euros of debt that, until now, was managed silently in the offices, with exponential growth in recent months.
The digitalization of the claim and consultation process, and its dissemination to the Spanish financial and business system through Informa D&B and the multinational EXPERIAN, has managed to put a stop to payment defaults and accelerate their recovery, in record time, with all the guarantees legal for the creditor and the debtor.
This revolutionary information and consultation service on judicial defaults has managed to expose the debt that until its creation was not registered in any other negative solvency file and that is now visible to everyone who has a legitimate interest in consulting it, favoring the recovery of sentences given the social pressure exerted on the debtor who has defaulted on the payment of the sentence.
In this way, thanks to this innovative technological tool, Spain is the first country in the world in which a debtor, who does not face a payment obligation, recognized in a final judicial resolution by a judge, can see how difficult it is for him to access to credit or doors are closed in its business operations.
In the same way, access to the file by lawyers allows a better knowledge of the solvency of potential clients or the opposing party, thus improving legal certainty.
The RIJ has therefore managed to provide the Spanish legal system with greater legal and financial transparency, helping to guarantee the right to effective judicial protection and warning of future risks of non-payment to reduce delinquency in our country.
After an unstoppable year, with the daily adhesion of new professional firms and Bar Associations through the signing of collaboration agreements and training seminars for their members, the RIJ concludes 2020 with a historic agreement with the multinational Experian, so that defaults by individuals and the self-employed also reach the financial and business system of the country, thus closing the circle with the dissemination since its creation, in 2019, of legal debts of legal persons through Informa D&B.
